An Adamawa High Court, presided over by Justice Musa Usman, has struck out a suit challenging the creation of Fufore Emirate.
The judge dismissed the suit due to the plaintiffs’ failure to prove any illegality in the creation of Fufore Emirate, along with six others, by Governor Ahmadu Fintiri, following the passage of a bill to that effect by the Adamawa State House of Assembly.
The presiding judge noted that the plaintiffs had failed to file or serve the defendants with the required one-month pre-action notice, and that there was no evidence that such notice had been filed or served.
In the suit, the plaintiffs—Musa Halilu Ahmed, Mustapha Dahiru, and Mustapha Ahmadu—challenged the creation of Fufore Emirate out of Adamawa Emirate.
The plaintiffs named the Adamawa State Government, Governor Ahmadu Fintiri, the Attorney General and Commissioner for Justice, and the Emir of Fufore as first, second, third, and fourth defendants, respectively.
The plaintiffs had argued that Governor Fintiri did not follow due process in creating Fufore Emirate and requested the court to declare the creation illegal, nullifying it and describing it as unlawful.
